Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website, platform, and services (collectively, the "Service") provided by Identity ("we," "us," or "our"), accessible at identityhub.app. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing, browsing, or using the Service in any way — including creating an account, connecting a third-party service, or connecting a blockchain wallet — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Identity is a Web3 reputation platform for the TON ecosystem. The Service aggregates publicly available data from connected accounts (such as GitHub, Telegram, X, and Instagram) and public blockchain data (such as TON wallet activity and SBT badges) to build verifiable reputation profiles. The Service may include features such as reputation scoring, leaderboards, contests, and profile management.

The Service is provided for informational and reputational purposes. Reputation scores and data displayed on the Service are generated algorithmically and do not constitute endorsements, certifications, guarantees, or verified credentials of any kind.

4. Account and Access

To access certain features, you may be required to authenticate via third-party services (e.g., GitHub OAuth) or connect a blockchain wallet (e.g., via TON Connect). You are solely responsible for:

  • Maintaining the security of your third-party accounts and wallet private keys.
  • All activities that occur through your account or connected services.
  • Ensuring that the information you provide or that is retrieved from connected services is accurate and up to date.

We are not responsible for any loss or damage arising from unauthorized access to your account caused by your failure to safeguard your credentials or private keys.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful or fraudulent purpose.
  • Attempt to manipulate, game, or artificially inflate reputation scores or activity data.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Service without our prior written consent.
  • Upload, transmit, or distribute any malicious code, viruses, or harmful content.
  • Violate any applicable local, national, or international law or regulation.
  • Infringe upon the intellectual property rights or other rights of any third party.

We reserve the right to investigate and take appropriate action against any violations of the above, including without limitation removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

6. Intellectual Property

The Service, including all content, features, functionality, software, text, graphics, logos, icons, and design elements, is owned by Identity and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service without our prior written consent.

The Identity name, logo, and all related trademarks are the property of Identity. You may not use them without our prior written permission.

7. User Content

By submitting, posting, or making available any content through the Service (including profile information, contribution descriptions, and review requests), you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and perform such content in connection with operating and providing the Service.

You represent and warrant that you own or have the necessary rights to submit such content and that it does not violate any third-party rights.

8. Blockchain Interactions

The Service interacts with the TON blockchain and may display data derived from on-chain activity. You acknowledge and agree that:

  • Blockchain transactions are irreversible. We have no ability to reverse, cancel, or modify any blockchain transaction.
  • We do not control, operate, or maintain the TON blockchain or any other blockchain network.
  • On-chain data is publicly accessible and immutable. Once data is recorded on the blockchain, it cannot be deleted or modified by us or anyone else.
  • You are solely responsible for any interactions with blockchain networks, including connecting wallets and any resulting transactions.
  • We are not responsible for any loss of digital assets, including but not limited to tokens, NFTs, SBTs, or any other blockchain-based assets, regardless of cause.
  • Blockchain networks are subject to risks including but not limited to network congestion, protocol changes, smart contract vulnerabilities, and regulatory uncertainty.

9. Third-Party Services

The Service integrates with and relies on third-party services, including but not limited to GitHub, Telegram, X (formerly Twitter), Instagram, and the TON blockchain. We do not control these services and are not responsible for their availability, accuracy, content, security, or privacy practices. Your use of third-party services is governed by their respective terms and policies. We make no warranties or representations regarding any third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The results, data, reputation scores, or information obtained through the Service will be accurate, reliable, or complete.
  • Any errors or defects in the Service will be corrected.
  • The Service is free of viruses or other harmful components.

You expressly acknowledge and agree that your use of the Service is at your sole risk. Any data, information, or reputation scores obtained through the Service are for informational purposes only and should not be relied upon as the sole basis for any decision.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IDENTITY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, DIGITAL ASSETS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to, use of, or inability to use the Service.
  • Any conduct or content of any third party on or related to the Service.
  • Any content or data obtained from or through the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any blockchain interactions, including loss of digital assets.
  • Any inaccuracies in reputation scores, activity data, or other information.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Identity and its officers, directors, employees, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of or access to the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any content you submit or make available through the Service.
  • Your blockchain interactions or wallet activities.

13. Termination

We reserve the right to suspend, restrict, or terminate your access to the Service at any time, for any reason or no reason, with or without notice, and without liability to you. Reasons for termination may include, but are not limited to, violations of these Terms, suspected fraudulent activity, or requests by law enforcement.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.

14. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration in accordance with applicable arbitration rules.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Identity regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

17. Waiver

The failure of Identity to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Identity.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will revise the "Effective date" at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
